TERMS OF SALE (CDV)

ChamonixMontBlancGuides (CMBG) defines its CDV according to the specificity of its trips.

They are sporty and require a significant physical commitment. It is your responsibility to check before registration that the level required on the description of the stay corresponds to your abilities. If in doubt, we are at your disposal. We reserve the right not to accept a participant who does not meet the level criteria.

For a trip with a private guide or a tailor-made stay, contact us.

■ REGISTRATION DETAILS
Registration implies acceptance of the general conditions of sale and is equivalent to a reservation to the extent of available places. The registration form must be dated and signed and the deposit paid.

The person who registers in the name and on behalf of several participants under- takes to transmit to each of the information provided by CMBG.

Deposit payment

The booking form will be accompanied by a deposit of 100% of the stay. We will notify you of its receipt by email or by default, by mail.

If the course is not listed, or you wish to pay in two halfs, then a 50% deposit must be paid either via credit card or bank transfer, in order to reserve your place. Please get in touch by email for this payment option.

Billing

An invoice is issued upon receipt of your deposit.
In accordance with article L221-28 of the Consumer Code, you do not benefit from a withdrawal period for the purchase of travel services.

Confirmation of departure

The stays are subject to a minimum number of participants. If the number is not reached, you will be informed of the number of registered:
- 21 days before departure for packages whose duration exceeds 6 days
- 7 days before departure for packages lasting 2 to 6 days

- 48 hours before departure, the duration of which is less than 2 days
You can then:
- either accept a modification of the stay (price, itinerary or services).
- or accept a transfer of your registration to another travel agency, for a replacement stay.

- either cancel your participation and obtain reimbursement of the sums paid, wit- hout claiming any compensatory compensation.

All costs incurred by you remain at your expense (purchase of plane or train tickets, equipment, hotel ...), in the event of cancellation of the departure or modification of the departure. We recommend that you purchase modifiable or reimbursable services.

Payment of the balance

The balance must be paid at the latest, without reminder from us 31 days before departure without reminder from us.
In case of registration below this deadline, the full price will be paid upon booking. Any delay in the payment of the balance may be assimilated to a cancellation for which cancellation fees will be applied.

Changes requested by the customer before departure

Flat rate per person:
- If you want to reserve equipment other than that of CMBG: 5 €

- If you want additional or different accommodation: 5 €

Medical certificate

The medical certificate of no contraindication to the practice must be provided.

 

■ CANCELLATION / POSTPONEMENT / INTERRUPTION OF STAY BY THE PARTICIPANT

You must cancel your participation before departure

Notify CMBG immediately in writing. The date of issue of this letter or email will be used as the cancellation date for billing the cancellation fees.
Notify the insurer by the means it recommends. The insurer will assess, on the basis of the documents you send it directly, the date of the event that gave rise to the cancellation of your trip to reimburse you for the cancellation costs.

General schedule of cancellation fees:

- more than 60 days: 30% of the total amount of the stay
- from 60 to 21 days before departure: 45% of the total amount of the stay - from 20 to 15 days before departure: 60% of the total amount of the stay - less than 15 days before departure: 100% of the total amount of the stay

Specific schedule of cancellation fees:

A specific scale which cancels and replaces the general scale can be indicated on in the “budget” section of the stay and / or on your invoice to match that of the suppliers (airlines, boat, etc.).

The insurance premium and the registration fees are not reimbursable either by the insurer or by CMBG.

If you have taken out an insurance contract, the cancellation costs will be covered after the acceptance of your file. Any insurance reimbursement procedure can only be started if you have paid the full amount for which you are liable. Otherwise, we block the procedure and lose the sums already paid.

You must postpone your participation

A postponement is a cancellation for which cancellation fees will be applied.

Private stay: You must cancel your participation before departure

If a participant registered on a private and / or tailor-made trip cancels his partici- pation in a trip maintained for the other participants, he will be charged for the one who cancels:
- the cancellation costs referred to in the above article as well as:

- the costs and / or the various costs incurred by CMBG to allow the subscribed trip to be maintained at the same price for participants already registered and who maintain their participation in the trip. In any event, the price of a privatized and / or tailor-made trip is fixed according to a determined number of participants and the services required to complete the trip. The cancellation of one or more participants therefore has a direct impact on the price of the trip for all participants remaining registered. These additional costs are to be borne by the participant who cancels his participation in the trip.

You must interrupt your stay

If you have a contract, the insurance will reimburse you according to the conditions of the contract. CMBG is not a substitute for insurance. No reimbursement may be required from CMBG for any reason.

■ CANCELATION / POSTPONEMENT / MODIFICATION / INTERRUPTION OF STAY BY CMBG

Cancelation

If the stay is canceled before departure for all participants, for whatever reason (lack of participants, refusal of administrative authorization, ...), you will receive a refund of the sums paid without being able to claim compensation.
An alternative solution may be offered to you. If it does not suit you, you will receive a refund of the sums paid without being able to claim compensation.

Postponement

If the stay is postponed before departure, for whatever reason (conditions on the ground, places in shelters, illness of the guide, etc.), you have the choice between a refund of the sums paid, or acceptance of the modification without being able to claim compensation.

Interruption

If the stay is interrupted for all participants, for any reason other than the level of the participants, you will receive either a refund of unused services or a commer- cial credit of a higher amount valid until December 31 of the following year.

If the stay is interrupted for one of the participants, on their own initiative or at the request of the guide, no refund or compensation can be required. The guide may require that one of the participants who does not have the level interrupts their stay. As the stay continues for the other participants, a lack of level is considered a cancellation on the part of the participant and refers to the paragraph “You must interrupt your stay”. No reimbursement or compensation may be required.

In collective options, you are teamed up with one or more other trainees. The failure of one of the participants may result in the interruption of the race. No reimbursement or compensation may be required. If this constraint linked to the concept of a rope does not suit you, we invite you to book a private guide.

Modification

Given the particular nature of our stays, program changes may occur during the stay depending on the level of the participants, the conditions on the ground (...). The guide has sole discretion to carry out, modify or interrupt the planned program in order to ensure your safety.

- Major modification: you have the choice between reimbursement of unused ser- vices or acceptance of the modification. This concerns changes such as dates, an increase of more than 8% in the price...

- Minor modification: no reimbursement, no compensation can be requested and no additional costs will be asked of you. Knowing how to adapt to the terrain is the very essence of the mountaineer. Each program is given for information only and can be adapted to the terrain and the group. We prefer to disrupt the logistics at the last moment rather than take you to an area that has become dangerous. You are buying a high mountain activity, an attempt to reach a summit, you are not buying THE summit. A minor modification cannot be considered as non-performance or poor performance of the contract services. This concerns changes such as time- tables, itineraries (change of sector, summit, ascent route, refuge, etc.).

Additional costs: All costs that you have incurred relating to the package pur- chased at CMBG remain your responsibility (hotel, transport, visa, equipment, etc.). We advise you to make modifiable and/or refundable reservations. CMBG cannot be held responsible for refunding cancellation or modification fees.

 

■ INSURANCES
It is essential that you have travel insurances : Assistance-rapatriation, search- rescue. If you don’t have search-rescue contract, we have negotiated with GBCMONTAGNE, a contract to cover sporting activities, throughout the world, without altitude limit. Contract 7.906.083. Please ask for price and conditions.

■ PUBLIC LIABILITY
In accordance with the regulations, we are insured for professional liability of travel agencies. HISCOX. 12 quai des Queyries. 33100 Bordeaux. This does not replace the individual civil liability that each participant must have.

■ LIABILITY
CMBG cannot be held responsible for the consequences of the following events:
- Loss or theft of transport tickets by the traveler
- Failure to present to the authorities and / or carriers the administrative and / or health documents required to undertake the journey and / or cross the borders, in accordance with the information given by CMBG
- Arrival after the scheduled time for check-in and / or boarding of any transport journey, particularly air.
- Unpredictable or unavoidable events of a third party such as: wars, political unrest, strikes outside CMBG, riots foreign to CMBG, technical or administrative incidents outside CMBG, congestion of air space, bad weather, delays (including included in mail delivery services ...), breakdowns, loss or theft of luggage or other personal belongings of travelers
- Cancellation imposed by exceptional and unavoidable circumstances, and / or for reasons related to the maintenance of passenger safety, and / or injunction by an administrative authority: in this case, CMBG reserves the right to modify the dates, schedules or itineraries provided for the purpose of ensuring the safety of travelers, with no possible recourse for them
- The person registering in the name and on behalf of all participants in the trip agrees to transmit to each traveler the information provided by CMBG concerning the trip so that CMBG cannot be held responsible for any defect or omission in the communication of this information.
In the event of CMBG’s liability being brought into play due to the actions of the service providers, the compensation limits provided for in international conventions will be applied, in accordance with article L 211-17- IV of the Tourism Code. Except in the event of bodily injury, the maximum financial liability of CMBG will be equal to three times the total price of the trip.
Each client must comply with the instructions of the expedition leader repre- senting the agency, which cannot be held responsible for incidents, acci- dents or personal injury that could result from a reckless initiative.

■ SAFETY AND HEALTH RISKS
Before departure, consult the travel advice section on the country file at https://www.diplomatie.gouv.fr
CMBG may require you to sign the country sheet as part of its information obligation.

■ ACCOMODATION
Accommodation is usually provided in shared rooms. Depending on the composi- tion of the group, you may be with someone of the opposite sex. When possible, we offer individual rooms, at an additional cost.

■ PRICE
The price per stay and per person is fixed on the basis of a minimum number of participants mentioned in the tour offer. Depending on the number of registrants, we inform you no later than 21 days before your departure of the cancellation, post-ponement, modification of the stay (see § Cancellation/postponement/Modification by OM.)

■ ASSIGNMENT OF THE CONTRACT
In accordance with article R.211-7 of the Tourism Code, you have the option of assi- gning your contract to an assignee who fulfills the same conditions as you for the stay as long as this contract has not produced any effect. You are required to inform CMBG of your decision by any means necessary to obtain an acknowledgment of receipt and at the latest 7 days before the start of the stay.
The assignor and / or the assignee are responsible for paying the costs that would be incurred as a result of the assignment.

■ PERSONNAL INFORMATION
The information you transmit to us is recorded in a computerized file by CMBG / Odyssée Montagne, SARL registered with the RCS of Bonneville under the number 393 593 397, whose head office is located at 291 Les Barbolets. 74310 Servoz, in its capacity as data controller.
The personal information collected is used to organize your stay, to offer you similar services or offers that may be of interest to you, to compile statistics, to send you newsletters.
CMBG / Odyssée Montagne agrees not to transfer or sell personal data concerning you to non-partner third parties.
Your data is kept for the time of our contractual relationship and for the duration necessary to meet a legal or regulatory obligation. In accordance with the amended IT, files and freedoms law N ° 78-17 of January 6, 1978, you have the right to access, object (in particular to sending marketing communications), rectify, limit and deletion and a right to portability on personal data concerning you. You also have the right to define directives concerning the fate of your personal data after your death. These rights are exercised by post to our address. You have the right to lodge a complaint with the CNIL if you consider that we do not comply with the applicable regulations on personal data.
In accordance with article L 223-2 of the Consumer Code, you have the option of subscribing to a list of opposition to door-to-door sales.

■ CLAIM
During the stay: You are required to inform CMBG of any non-compliance observed during the stay by contacting us immediately at the agency during opening hours, or at the emergency number provided in your travel diary. Failure to report may have an influence on the amount of possible damages if reporting without delay could have avoided or reduced the damage.

After the stay: Any complaint must be sent to CMBG, by registered letter, with supporting documents. In the absence of a satisfactory response from us or in the absence of a response within 60 days, the customer can contact the Tourism and Travel mediator, whose contact details and referral procedures are available on the website www.mtv. travel.

■ NO SOLICITATION
The client undertakes not to contact the guide who was previously presented to him by CMBG, in order to form a service contract without going through CMBG, which would then be justified in asking him for compensation depending on the sustained prejudice.
This clause will apply even if the solicitation is initiated by the guide.

■ TRAVELER’S RIGHT
The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the Tourism Code.
You will therefore benefit from all the rights granted by the European Union appli- cable to packages, as transposed into the tourism code. CMBG will be entirely responsible for the proper execution of the package as a whole.
In addition, as required by law, the company CMBG / Odyssée Montagne has pro- tection to reimburse your payments and, if transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.
